Nachschlag von 5,57 % für nach Art. 112 ausgezahlte Zinsgläubiger

Dies betrifft alle Kaupthing-Sparer, die im August 2013 ihre Zinsen nach Art. 112 als vorrangige Gläubiger erhalten haben (siehe hier).

Die Kaupthing-Insolvenzverwalter wählten damals für die Auszahlung den (für Kaupthing günstigen) Umrechnungskurs zum 22.04.2009.

Dagegen hat die Aresbank SA geklagt und nun dahingehend Recht bekommen, dass als Umrechungskurs der (für die Gläubiger/Sparer günstige) Auszahlungstag des 16.08.2013 anzusetzen war.

Daraus ergibt sich eine Differenz zugunsten der genannten Gruppe von 5,57%. Die Kaupthing-Insolvenzverwalter kündigen die Auszahlung dieses Betrages an.

Judgement of the Supreme Court of Iceland in case no. 707/2014, Kaupthing hf. v Aresbank S.A.

On 16 August 2013, Kaupthing distributed payments to creditors holding accepted claims under article 112 of the Bankruptcy Act (“priority claims”). As all priority claims had been converted to Icelandic Krona in accordance with paragraph 3 of article 99 of the Bankruptcy Act, payment of priority claims was to be made in Icelandic Krona. Creditors were however given an option to have their payment made in euro converted at the exchange rate as at 22 April 2009 (“euro-option”)

The dispute in the case concerned whether Kaupthing was allowed to use the exchange rate as at 22 April 2009 to convert and pay creditors with accepted claims under article 112 of the Bankruptcy Act in accordance with the terms of the euro-option or whether the exchange rate on the date of payment, 16 August 2013, should have been applied.

The Supreme Court found that the Bankruptcy Act did not allow for Kaupthing to use any other exchange rate, to convert and calculate payments of claims in Icelandic Krona to foreign currency, than the quoted selling exchange rate on the date of payment.

As a result, Kaupthing will recalculate and distribute payments to those creditors that received payment of their priority claims in euro. The difference between the EUR/ISK exchange rate on 22 April 2009 and 16 August 2013 is 5.57% and is estimated to result in additional payment for Kaupthing of EUR 4.6 million to the respective creditors.

It should be noted that as part of its reasoning the Supreme Court found that a liquidator in bankruptcy is, under the Bankruptcy Act, allowed (but not obliged) to use funds in foreign currency to pay creditors, whose claims were originally in foreign currency and that a liquidator in bankruptcy is furthermore allowed (but again not obliged) to use Icelandic Krona to buy foreign currency on the market and distribute that currency to foreign creditors. The liquidator would, in both instances, when converting the claim in Icelandic Krona to foreign currency, need to apply the rate of the respective currency on the date of payment.

Ich habe gleich mal 150 NZD im Namen von Helft-Uns gespendet, da ich das Projekt gut finde! Viel Erfolg Hörður Torfason! Irgendwie passt auch das Motto: “When I becomes we.”. Bei der Gelegenheit fällt mir auch wieder ein: Hat Karlheinz Bellmann eigentlich schon seine Zinsen nach Island gespendet? Wenn nicht wäre das eine gute Alternative 😉

Dear friends.

I have been around as an artist and an human right activist for for a very long time with good results. One of my projects was The Cutlery Revolution in Iceland in the winter of 2008/09. In recent years I have been invited to 15 countries (some more than once) and I don´t know how many cities, to do my talk that I call: “When I becomes we.” and answer questions about my views and methods that are based on my standing point; I always work in the spirit of the society I want to live in.

On my speaking tour in New Zealand, early 2013, I was interviewed by the journalist Alastair Thompson (Publisher of Scoop Independent News.) and later we decided to work together on a book about The Cutlery Revolution. We have used the working title „Civilised Revolution”.

The name „Civilised Revolution“ comes from the fact that in Iceland the word for „Civilisation“ is the same as that for „Cutlery“ ( because before cutlery the world was less ciivilised ). The Cutlery Revolution is so-called because in the immediate aftermath of the beginning of the Great Financial Crisis I called together thousands of Icelanders to surround the Parliament and bang pots and pans until the government resigned and new elections were called. The revolution thereby peacefully achieved significant political change within a democratic constitutional framework during a period of very significant crisis.

However the full story of what happened and how is much richer than that and full of drama. And it contains some very valuable lessons about how to achieve political change – lessons which I suspect could help activists facing similar crises in other parts of the world.

Now we have started a crowd-funding site on a project called Civilised Revolution ( Civilized Revolution ). Sicher haben es viele schon mitbekommen, dass in Island wieder ein Vulkan (Bardarbunga) aktiv ist. Hierzu ein guter Hintergrundbericht von ZDF heute nacht. Auszug:

Frühere Direktoren der Kaupthing Bank zu mehrjärigen Haftstrafen verurteilt

Wegen Manipulation der Aktienkurse wurden zwei frühere Direktoren zu mehrjährigen Haftstrafen verurteilt. Der frühere Kaupthing-Chef Heidar Már Sigurdsson erhielt eine fünfeinhalbjährige Haftstrafe, während Ex-Aufsichtsratschef Sigurdur Einarsson fünf Jahre hinter Gittern muss.

Agreement reached between Kaupthing and Sheikh Mohammed Bin Khalifa Bin Hamad Al Thani

Kaupthing hf. and Sheikh Mohammed Bin Khalifa Bin Hamad Al Thani, together with other related parties, have reached an agreement concerning the settlement of all claims and liabilities between them. This agreement has been reached on a commercial basis with no admission of liability by any party. As a result of the settlement, the proceedings commenced in Iceland by Kaupthing against Sheikh Mohammed Bin Khalifa Bin Hamad Al Thani have been discontinued and all other claims and liabilities have been released. All other terms of the settlement remain confidential.
