Schreiben zur Entscheidung der Nachrangigkeit, mit Hinweis auf Möglichkeit des Einspruchs

Aufgrund zahlreicher Nachfragen hier die Abschrift eines Schreibens des WuC vom Januar 2010, welches in diesem Wortlaut all denjenigen per Briefpost zugesandt wurde, die Zinsen (korrekt) geltend gemacht hatten. In diesem Schreiben, das meines Wissens zwischen November 2009 und Mitte Januar 2010 versendet wurde, wird u.a. mitgeteilt, dass Zinsen, die für den Zeitraum bis 22.04.09 als vorrangig (Art. 112) geltend gemacht wurden, nur als nachrangig (Art. 113) anerkannt wurden. Ferner wird mitgeteilt, dass man gegen diese Entscheidung bis 29.01.2010 – z.B. mit Hilfe des entsprechenden Formblatts auf www.kaupthing.com – formell Einspruch einlegen kann. (siehe von mir fett hervorgehobener Absatz)
Da ich selbst noch für Mitstreiter bis Ende 2011 Einsprüche formuliert habe, denen stattgegeben wurde, war diese Frist offensichtlich dann doch nicht die letztmögliche Frist.

Notification Regarding a Claim Filed Against Kaupthing Bank hf.
The Winding-up Committee of Kaupthing Bank hf. has reviewed the above numbered claim that has been filed against Kaupthing Bank hf. In accordance with paragraph 2, Article 119 of the Bankruptcy Act, you are hereby notified that the Winding-up Committee, having reviewed your claim and in reliance on any supporting documentation provided, does not accept your claim under article 112 of the Bankruptcy Act due to the reason that accrued interests and penal interests, both pre and post 22. April 2009 cannot be considered a priority claim as provided for in Article 112. However, please be advised that the Winding-up Committee does recognise and accept a part of your claim in the sum of ISK xxx.xxx under article 113 of the Bankruptcy Act. Apart from the aforesaid the Winding-up Committee does not recognise your claim regarding interests for the time period after the 22 nd of April 2009 and penal interests. The reason is that claim for interest post 22. April 2009 and penal interests is a deferred claim as provided for in Article 114 of Act no. 21/1991 on Bankruptcy etc.
Notice is hereby given that a creditors’ meeting will be held on Friday 29 January 2010 at 10:00 a.m. at Hilton Hotel Nordica, Sudurlandsbraut 2, Reykjavik, Iceland. The meeting will discuss the list of filed claims and the Winding-up Committee’s determination as to the recognition of claims insofar as it is available.
A list of filed claims will be made available to parties who have filed claims on 22 of January 2010 on webpage www.kaupthing.com. The list of filed claims is located at a secure site for creditors which is accessible by a username and a password. Your username is: CREDITOR and your password is: xxxxxxxx. We draw your attention to the fact that the list of filed claims and other material which is published on the secure site is confidential, is only to be accessed and used by creditors and is not to be disseminated to third parties (other than your legal and professional advisers who must also keep the contents confidential). In accessing such information, you agree to, and will procure that your advisers will, keep the contents confidential.
According to the Act no. 21/1991 on Bankruptcy [etc], any claimant who does not accept the Winding-up Committee’s decision may lodge an objection with the Winding-up Committee. If you want to lodge an objection to a decision made by the Winding-up Committee, you must deliver your objections in writing to the Winding-up Committee no later than the creditors´ meeting on 29 January 2010. A proforma objection may be found on webpage www.kaupthing.com which should be completed and sent for receipt by the Winding-up Committee prior to, or delivered at, the creditors´ meeting. If objections against the Winding-up Committee´s recognition of a claim are not raised either before or at that meeting, the Winding-up Committee´s recognition of the claim may be considered final according to Paragraph 3 of Article 120 of the Act no. 21/1991 on Bankruptcy [etc].
Due to the scope and number of filed claims, the Winding-up Committee will not have been able to make a determination of all claims prior to the creditors‘ meeting on 29 January 2010. The Winding-up Committee will convene a follow-up creditors´ meeting on 18 May 2010 at 10:00 a.m. at Hilton Hotel Nordica, Sudurlandsbraut 2, Reykjavik, Iceland, to continue discussion of the Winding-up Committee’s recognition of claims that have not already been finalised on 29 January 2010. If the process of claim recognition is not completed before the follow-up creditors´ meeting, the Winding-up Committee will convene another follow-up meeting later in 2010 to conclude discussion of the Winding-up Committee’s recognition of any outstanding claims.
Please note that the Winding-up Committee has not made a determination with respect to deferred claims under Article 114 of Act no. 21/1991 on Bankruptcy [etc] in accordance with Article 119 of the Bankruptcy Act.
